We are not responsible for the content or activities in any user-created, non Crazy Mates managed Service. Our sites are general purpose sites and are designed for use by individuals that are 16 years of age or older.
Respect Others- We encourage everyone to treat each other with mutual respect. Do not use the site to threaten, harass, stalk, or abuse others participating in any. Refrain from all expressions of bigotry, racism, homophobia, hatred, foul language or profanity.
We encourage our users to create their own web pages and communities. The creators of these pages/areas act as Hosts. Hosts may eject or ban a user from their area if a participant violates one of their guidelines or these Terms + Conditions. By participating in a user-created area, you agree to be bound to the rules of that area. Managers and/or Hosts who manage the Crazy Mates Services may eject or ban users, as well as remove postings that violate these Terms + Conditions. You may not redistribute images, photos or any personal data that you have found, copied or downloaded from a member page or a page hosted on the server. Please respect the privacy of others.
Keep it Legal- We do not allow any illegal activities. You cannot use our Services to publish post, distribute, or disseminate defamatory, infringing, obscene, or other unlawful material or information.
Do not upload files or post messages that contain photos, software or other material protected by intellectual property laws, rights of privacy or publicity or any other applicable law unless you own or control the rights thereto or have received all necessary consents. We are not responsible for any use of anything you say or post. Do not upload files or photos, software or other material that may be considered to be pornographic, vulgar, political, or offensive to any other users. Do not post any materials (including software and other information, including links to other websites) that could harm (or is designed to harm) other users' computers or would allow others to inappropriately access software or sites.
Play Nice- We do not tolerate disruptive activity online, such as persistent off-topic comments and postings or statements that incite others to violate these Terms + Conditions or participate in illegal activities. Our participants want to chat and use other Services in a positive environment. We do not allow posting or use of computer programs that contain destructive features such as: viruses, worms, Trojan horses, or bots for the use of scrolling, showing multiple screens, and other activities that can be disruptive to online communication.
Falsely impersonating an employee, agent, manager, host, or any other person with the intent to mislead or cause harm to others is forbidden. You must not take active steps to increase your page hit counter or search result ranking by purposeful repetitive use or page refreshing techniques or engage in any other activity that will affect your status in a way which is unfair to other members. We have provided you to self-rate and categorize the user-created areas of the Communication Services, We reserves the right to change the rating or re-categorize all user-created areas.
Don't Spam- Please don't 'spam' through the Communication Services available with, none of our users like it. To spam includes sending identical and irrelevant submissions to many different discussion groups, mailing lists or communities. Usually such postings have nothing to do with the particular topic of the group or are of no real interest to those on the mailing list. It also includes misrepresenting the source of anything you post. Spamming is a serious violation of online etiquette.
We reserve the right to ban a user at any time, without notice, from any or all Services for spamming. The Communication Services areas may be used to provide supplemental information regarding your own business (provided you do not use spam to provide this information); however, the Communication Services areas are not designed to be used as the primary mechanism for operating your business or providing core information about your business. Any use of the Communication Services for commercial purposes is solely at your own risk and we have no liability for such use.
Any space provided to you by us is for your own personal use. You may not sell, license, exchange or barter any space provided to you within any Communication Service for any purpose including, without limitation, selling, licensing, exchanging or bartering space for advertisements.
Take Responsibility- you are responsible and liable for all your activities while participating in Crazy Mates and associated Internet Services. Remember, you are responsible for anything you say, publish or post. Crazy Mates offers our users the ability to create their own areas (e.g. chat, communities and personal web pages). We take no responsibility for the ratings, content, nor any activities resulting from the content or otherwise, in these areas. The creators or hosts of these user-created areas are required to agree to and uphold these Terms + Conditions. The Crazy Mates Domain(s) are not designed as the primary places to store any materials; you are responsible for creating backups of materials you post to us such as photos, documents and software. We are not responsible for loss of access to, or deletion or alteration of any materials included in any Communication Service.
We reserves the right to remove at any time, without notice or explanation, any member account or user-created Service or any particular posting that violates these Terms + Conditions. Some users may post Internet website links in their area. Please be advised that Crazy Mates is not responsible for the content on the websites associated with the links you may view. Some content and links on the Internet may contain adult content and may not be suitable for children. We encourage parents to join their children as they surf and explore the Internet.
All content that a member publishes to their profile (including text and pictures) is considered to be part of the public domain and the Internet. It is not possible to control or monitor against the theft any element that goes to make up your profile and as such you should be aware that any information or content that you post is freely available to the public. |We are not responsible for any theft or infringement resulting directly or indirectly from the use of the Crazy Mates Services.
You are responsible for any actions you may take based on advice or information you receive online. Use your own good judgment when evaluating information provided through any Communication Service, remember that the information provided could be from people at any age and experience level. The decision to conduct transactions with anyone is your own and you should conduct your own research prior to making any decisions.
General Notes- although we strive to provide the best facilities we can to ensure maximum speed and availability from our servers and software, Crazy Mates does not offer any SLA (Service Level Agreement) or any guarantee in relation to Service up-time or availability for any Service, Product or Premium Subscription Service. All Services provided are on an 'as is' basis. All Premium Subscription Services, are non transferable and apply to 1 member account only. This is the account from which the product or subscription was purchased. All Premium Subscription Services are non refundable.
We reserve the right to add, remove or amend any feature or Service at any time without notice, explanation or liability without limitation. We reserve the right to increase or reduce the price or alter the content or features of any Premium Subscription Service or Product without prior notice, explanation or liability.
Uphold the Code- In helping to make the Internet a great place to meet and chat, you must do your part to uphold these Terms + Conditions. Faceparty reserves the right to immediately terminate or suspend access to any Service for violations of our Terms + Conditions. We reserve our right to amend or change the Terms + Conditions at any time without notice. You agree to periodically review this document to ensure you are doing your part.
Agreement- this Agreement is a legal document which sets out your rights and obligations, and those of Crazy-Mates Limited, a company registered in England. By using our website and or registering yourself as a member of the Crazy Mates Service, you agree to the terms of this Agreement. You should be aware that this Agreement may change from time to time.
Types of membership- People who register for the Where Are You Now Service become "Members". They must be at least 16 years of age. The Membership divides between those who decide to pay our fee for a full annual membership (which we call "Full Members"), and those who do not ("Standard Members"). We reserve the right to make any Standard Member feature a Full Member feature, or vice-versa from time to time. We are not an internet service provider, however. In order to use the Service, you must have internet access and all the software required for email and web usage.
Full Membership- If you decide to become a Full Member, and therefore pay our Full Membership fee, you are agreeing to take the Full Membership we make available to you shortly after that fee is paid. You will not be entitled to any refund of that fee subject to your statutory rights. If you wish to continue with Full Membership after any current Full Membership expires, we will enable you to do so, at our then-current terms and prices. But please note that we reserve the right to change the amount of the fee for Full Membership, the period which it covers, the services which it enables you to obtain and other factors from time to time. These changes, will not affect your then-current Full Membership.
Registration- You undertake to register using accurate and current information about yourself – including your correct name, address and any other requested details. As part of the registration process, you will receive a verification email, the purpose of which is to take reasonable steps to ensure that the email address you have nominated during registration is controlled by you. That email contains instructions which you must follow to complete the registration.
Additional services- Crazy Mates or its affiliates may offer new or additional services to you from time to time. Your use of those services may be subject to additional terms and conditions, which you must comply with. Provided that those terms or rules are notified to you in an appropriate manner, as determined in its reasonable discretion), any failure by you to comply with a material provision of the terms or rules governing those services will amount to a breach of this Agreement.
Operations- we reserve the right to withdraw or modify one or more aspects of the Crazy Mates where we have legal or technical reasons to do so. There may also be times when our service becomes unavailable, whether on a scheduled or unscheduled basis. For security or other reasons, we may require you to change password or other information, which facilitates access. Misuse- We reserve the right to suspend or terminate any Member’s access to the service, or parts of it, and edit, or require the Member to edit, material posted on the site, if the relevant Member or material appears to us to be in breach of any provision of this Agreement. Any person whose access has been suspended or terminated must not re-register for, or re-access, the service without our prior consent. You are responsible for everything, which is done on or through the site while your Membership account is logged on to the site, or through your email addresses.
Relevance- members must not:
- include an email address, postal address, phone number, the address of any website, or any other information which is intended to facilitate direct communication, in material which is posted on the Crazy Mates Site (We have technology in place to remove any such information automatically from material posted via the site, this includes electronic messages sent through the system, messages posted to Forums & Discussion groups, and any other communication tools made available.
- place material on, or otherwise use, the Site for any business or commercial purpose; or
- use your access to the site for the sending of unsolicited bulk email (sometimes known as spam).
Fees-
(i) We reserve the right to provide a free service to all members for a period of up to 12 months following the launch of the service. We also reserve the right to incorporate a fee based service within that same 12 month period, should we deem it appropriate.
(ii) You acknowledge that we are entitled to alter the amount or the basis of the calculation of our fees from time to time, provided that such amount or basis is clearly stated at the time when you agree to renew or extend your Service.
(iii) Fees paid by a Full Member will not be refunded by Crazy Mates, unless the Service for which the Full Member has subscribed is completely withdrawn from that Full Member by us other than in circumstances permitted under this Agreement or where the Member has abused our Services. We reserve the right to offer full or part refunds at our discretion when the management acknowledges a justifiable reason to do so.
We may add new or ancillary services from time to time, which require the payment of fees – either to us or a nominated third party – on terms, which will be provided to you at the time if you elect to subscribe to them.
Prohibitions- you are responsible for ensuring that no material you post, or which is posted through a machine on which you access the site, nor any activity or communication you make in connection with Crazy Mates, will be capable of (a) infringing the intellectual property or other rights of any person or entity, (b) breaching any applicable law, whether criminal, tortuous or otherwise, or (c) appearing to be offensive, threatening, obscene, pornographic, false, unreliable or misleading.
Alerting- We don’t generally monitor material contributed by Members before it is placed on the website and so we are reliant upon users to point out any which is in breach this Agreement.
Withdrawal of material and Termination of Membership- each Member acknowledges that we are entitled to withdraw any site, whether this is based on information received from Members or others, or our own determination to be capable of breaching any part of this Agreement, or to bring the site into disrepute. However, you acknowledge that we do not monitor material which appears on Site, and that we are reliant upon you and all users to notify us of anything you see here which appears likely to breach this Agreement, using the notification techniques, which are made available.
Disclaimer and Release- we have no control over, or responsibility for, the truth or accuracy of any material available on the Site, whether provided by Members or others.
- If any third party sites are linked to, or from, the site, this does not mean that we endorse or have any responsibility for the site in question or anything that appears on it.
- You should exercise no lesser degree of caution in what you see on the Site than you do offline.
- Even though Members are prohibited from doing so, people may provide information, or otherwise behave, in a way that is unreliable, misleading or even illegal. Further, you should note that people may not necessarily be who they say they are.
- Your use of the Crazy Mates is entirely at your own risk. Accordingly, to the extent that the law permits, you release Crazy Mates, its directors, contractors and employees, from all liability arising out of or in connection with the Site and the material included here by Members and other third parties.
Intellectual Property- You acknowledge that all copyright, trademarks, and other intellectual property rights in and relating to the Site (including the material which is contributed by Members) are owned by Crazy Mates. It is easy to copy material that appears on web sites, but this does not mean it is legal. Therefore, no one may copy, distribute, show in public or create any derivative work from the Site, or any of the material, which is found, unless properly licensed to do so by us.
By submitting any material to the content of the Site, you:
- are representing that you are fully entitled to do so;
- grant us a non-exclusive, royalty-free, irrevocable and perpetual licence to copy, modify, distribute, show in public and create derivative works from that material in any form, anywhere; and
- authorise us to adapt the relevant material in the course of doing so, and so waive your moral rights to object to any derogatory treatment, or to be identified as the author, or have procured a waiver of moral rights from the copyright owner, as the case may be, of the material in question.
Excluded loss- we will not be liable to you or any third party for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business, howsoever caused (whether arising out of any negligence or breach of this Agreement or otherwise). We will also not be liable for any failure to perform its obligations under this Agreement caused by matters beyond its reasonable control.
Maximum liability during any period of twelve months, the aggregate liability of Crazy Mates under this Agreement (whether arising in negligence or otherwise) will not under any circumstances exceed the greater of (a) £5, or (b) an amount equal to the sums paid by you to us by way of Full Membership fees during the relevant period of twelve months, regardless of the cause or form of action.
Non-excluded Liabilities- liability for death or personal injury resulting from our negligence, or any other liability which may not by law be excluded. Any statutory rights you may have as a consumer remain unaffected.
Indemnity- You agree to indemnify us against all liabilities, claims and expenses that may arise from any breach of this Agreement by you or through a machine on which you access the Site.
Severability- in the event that any term of this Agreement is held to be invalid or unenforceable by judicial decree or decision, the remainder of this Agreement shall remain valid and enforceable.
Law- this Agreement shall be governed by in accordance with the laws of England and Wales.
